Terms of Service

These terms are an agreement between you and Clusterlean AB, a company registered in Sweden (org. nr 559361-2913, Nordanväg 3 A, 222 28 Lund, Sweden) ("Clusterlean", "we"), which provides Rasanak. By creating an account or using Rasanak you agree to these terms, our Privacy Policy and our Refund policy. If you don't agree, don't use the service. Contact: support@rasanak.com.

The service

Rasanak lets you browse and play audio files stored with cloud storage providers that you control, currently Backblaze B2 and Microsoft OneDrive. We store library metadata and your encrypted access keys or tokens; audio is streamed directly from your storage provider to your browser. We don't host, review or back up your audio. Backblaze, Microsoft, Stripe and our hosting providers are independent third parties: you are responsible for your storage accounts, their costs and their contents, and we are not responsible for their services.

Your account

• You must be at least 16 years old. If you are under 18, you need a parent's or guardian's permission to buy Pro.
• You must give a valid email address and accurate information, and keep it up to date.
• Keep your password, authenticator app and recovery codes safe. Two-step verification is required for every sign-in. You are responsible for all activity under your account, and we are not liable for losses caused by credentials you failed to keep secure. Tell us promptly about any unauthorised use.
• Accounts are personal. Don't share, sell or transfer your account.

Your content

You keep all rights to the audio and metadata in your storage. You give us a limited, non-exclusive, worldwide, royalty-free permission to access, read and process it only as needed to run Rasanak for you, for example to read tags and stream files to your browser. You confirm that you own, or have the right to use, everything you connect, and that using it with Rasanak doesn't infringe anyone's rights or break any law. We may remove access to content or suspend an account when we receive a credible notice that content is infringing or unlawful.

Acceptable use

You must not:

• connect or play content you don't have the right to use, or use Rasanak for anything unlawful;
• access or attempt to access other users' accounts or data, or probe, scan or test the service's security without our written permission;
• circumvent plan limits, security measures or rate limits, or put an unreasonable load on the service;
• use bots, scrapers or other automated means to access the service, other than the app itself;
• copy, modify, reverse engineer or decompile the service, except where the law expressly allows it;
• resell, sublicense or offer the service to others, or use it to build a competing product.

Our rights

Rasanak, including its software, design, logo and name, belongs to Clusterlean and its licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the service under these terms. All rights not expressly granted are reserved. If you send us feedback or suggestions, we may use them freely and without obligation to you.

Plans and payment

• Free: up to 100 tracks, at no cost.
• Pro: unlimited tracks for $12 per year (plus applicable taxes), billed in advance by Stripe and renewing automatically until cancelled.
• You can cancel at any time in the billing portal; Pro continues until the end of the paid period. After a subscription ends you keep full access for 30 days. After that nothing is deleted, but only your first 100 tracks by date added are playable and syncs are limited to the free plan until you renew.
• If a payment fails or is reversed, we may move your account to the Free plan until it is paid. Payments are non-refundable except as described in our Refund policy or required by law.
• We may change prices. We'll email you at least 30 days before a new price applies, and it takes effect from your next renewal. If you don't want to pay the new price, cancel before the renewal.

Suspension and termination

We may suspend or close your account, immediately and without notice, if you seriously or repeatedly breach these terms, use the service unlawfully, fail to pay, or put the service, us or other users at risk. We may also close accounts for any other reason with at least 30 days' notice, and will then refund any unused prepaid time. Sections that by their nature should survive termination, including Your content, Our rights, Disclaimer, Limitation of liability and Indemnity, continue to apply.

Availability and changes

We work to keep Rasanak available, but it may be interrupted for maintenance, updates or reasons outside our control, and may briefly start up after a period of inactivity. We may change, add or remove features at any time. If we discontinue the service we'll give reasonable notice and refund unused prepaid time.

Disclaimer

The service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties or promises, express or implied, including that the service will be uninterrupted, error-free, secure, or fit for a particular purpose, or that it will work with every file, format or browser. You are responsible for keeping your own copies of your audio. If you are a consumer, this does not affect your statutory rights.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, loss of profit, revenue, data or goodwill, or for loss of or damage to content in your storage provider, or for the acts or omissions of third-party services. Our total liability for all claims relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Claims must be brought within one year of when you became aware, or should have become aware, of them. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, intent or gross negligence, or any other liability that cannot be limited under applicable law.

Indemnity

To the extent permitted by law, you will compensate us for claims, losses and reasonable costs (including legal fees) arising from content you connect to Rasanak, your breach of these terms, or your violation of any law or third-party right.

Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, such as outages of hosting, storage or payment providers, internet failures, cyberattacks, labour disputes, government action or natural events.

Changes to these terms

We may update these terms. For material changes, we'll email you at least 30 days before they take effect. If you keep using Rasanak after that, you accept the updated terms; if you don't agree, you can cancel and delete your account before they take effect.

Ending your account

You can delete your account at any time in Settings. Deletion cancels any subscription and removes your data as described in the Privacy Policy.

General

These terms, together with the Privacy Policy and Refund policy, are the entire agreement between you and us about Rasanak. You may not transfer your rights under them; we may transfer ours to an affiliate or to a successor of our business. If any part is found unenforceable, the rest remains in effect. If we don't enforce a right, we haven't waived it. If these terms are translated, the English version prevails.

Governing law

These terms are governed by Swedish law. Disputes are settled by the Swedish courts, with Lund District Court (Lunds tingsrätt) as the court of first instance. If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country where you live, or of your right to bring proceedings there.
